Whereas Banc De Binary has offered an exclusive Trade to Paradise Competition (hereinafter: “Trade to Paradise Competition”) for individual client competitors (hereinafter: “Clients”) which includes the Client opening the most amount of winning positions on the trading platform throughout the duration of the Trade to Paradise Competition in order to win a prized vacation to Mnemba Island (hereinafter: “the Prize”).
And Whereas The Terms of Use hereby stipulate the conditions concerning the Trade to Paradise Competition and the Prize;
Therefore it was agreed between both parties as follows:
- Introduction
These Terms of Use govern your agreement and acceptance to participate in the Trade to Paradise Competition by opening the most amount of winning positions on the trading platform, when the minimum deposit for each trade is $30 (hereinafter: “Winning Trades”); by accepting the Trade to Paradise Competition, you accept these Terms of Use in full. If you disagree with any part of this Terms of Use, you waive your right to participate in the Trade to Paradise Competition and/or to request any prize offered by the Company throughout the Trade to Paradise Competition.
- Company General Terms of Use
The Trade to Paradise Competition Terms of Use is subject to the conditions detailed in the general “Terms of Use” appearing on the Company’s official website (hereinafter: “general T&C”) and in the event of any contradiction between that stated in the Trade to Paradise Competition Terms of Use and that stated in the Company’s general T&C, that stated in the general T&C will take precedence.
- Trade to Paradise Competition Duration
The Trade to Paradise Competition duration will commence 1 May 2015 and end 31 May 2015 at 11:59 P.M. (GMT). The Company may in its sole discretion revise the Trade to Paradise Competition duration by reducing and/or extending said period without advance notice.
- Winner Terms and Conditions:
In order to become an eligible winner of the Trade to Paradise Competition, the competing Client must abide by all of the below conditions:
- The winning Client is the individual who has traded on the platform with the most amount of winning positionsthroughout the duration of the Competition;
- Each of the winning positions opened on the trading platform by the Client must begin at the minimum of $30 and up;
- In case of reaching a tie between two individual potential winners at the end of the Competition duration, the final winner will be determined according to the highest ratio between both of the individual Clients.
- This section does not constitute an exhaustive list and any eligibility conditions will be determined in the Company’s sole discretion.
- The Prize
The winning Client of the Trade to Paradise Competition will win the following prize (hereinafter: “Prize”) in accordance with these Terms of Use:
- The Company will provide the winning Client with a 3 night stay at the Mnemba Island Lodge located on Mnemba Island (hereinafter: “the Hotel”).
- The winning Client can make a reservation for 3 additional guests to join him/her (4 individuals’ total) for the Prize vacation and will receive 2 hotel rooms which are suitable for 2 couples.
- The Company will provide the winning Client with the boat transportation to and from the island in addition to economy class flights.
- The winning Client will choose the dates that he/she wishes to reserve for the Prize vacation at the Hotel; the winning Client must use his/her vacation Prize within 3 months from the date of receiving the Prize from the Company.
- Additional Prizes
The Clients who come in second place and third place winners in the Trade to Paradise Competition will also be eligible to receive a prize:
- 2nd Place Winner – Can win a MacBook.
- 3rd Place Winner – Can win a GoPro.
- Amendments to the Prize
The Client acknowledges that the available prizes illustrated in sections 5 and 6 above do not constitute an exhaustive list of prizes and can be amended by the Company from time to time as deemed appropriate, to which the winning clients will be subject to without undermining its content.
- Exclusion of Warranties
- The Company does not warrant the completeness or accuracy with respect to information regarding the Trade to Paradise Competition, nor does it commit to ensuring the availability and/or the quality of the Prize vacation which includes inter alia the Hotel, the flight and boat transportation and any other aspects which are beyond the Company’s control. The winning Client acknowledges that the Company holds no responsibility regarding the Prize vacation and that the Company will not be liable for any loss and/or damage and/or claims with any issues pertaining to the vacation.
- The Company does not guarantee the availability of the dates that the winning Client chooses to reserve for his Prize vacation; the Hotel is legally responsible and authorized regarding the winning Client’s reservation, accommodation and all additional matters respectively and the winning Client will address all questions and/or topics and/or issues and/or queries regarding the Hotel and/or accommodation and/or travelling conditions, respectively to the separate authorized companies which are not affiliated with Banc De Binary.
- The Client acknowledges that Mnemba Island is a private island but nevertheless the Island attracts additional tourists and guests staying at the Hotel. The Company will not be liable for any loss and/or damage and/or claims with any issues pertaining to the Prize vacation.
- Limitation of Liability
The Client acknowledges that the Company will not be held liable to the Client in respect of any losses arising out of any event or events beyond the Company’s reasonable control, including, inter alia and without limitation, loss of and/or damage – whether special, indirect or consequential. Moreover, it should be emphasized that the Company may in its sole discretion determine regarding and not limited to the following: acceptance of the winning clients for the Prize vacation, 2nd Place winner and 3rd Place winner, discretion regarding the most amount of winning positions opened by the Clients, the duration of the Competition, availability of prizes, eligibility of Clients to receive a prize and related terms and conditions with respect to the Clients.
- Client Undertakings:
- The Client acknowledges and accepts that the Company may advertise the Client’s name and/or photo and/or information for marketing purposes and the Client agrees to waive his/her right to privacy and undertakes that he/she shall not have any claims and causes of action, now or in the future, with respect to the Company or against any entities affiliated with or related to the Company (hereinafter: the “Related Entities”).
- The Client will assume all responsibility in ascertaining that the Client’s country of origin will enable him/her to enter and/or exit from Mnemba Island. It must be emphasized that the Company will not be held liable for any and/or all matters and/or policies concerning the Prize vacation with respect to the applicable laws of the Client’s country of origin.
- The Client alone is obligated to calculate and pay any and/or all additional charges which may be applicable to him/her or otherwise arising as a result of his/her receiving the Prize. In addition, the Client is solely responsible for his/her and the additional guests Visa/travel insurances and/or policies.
- Company Discretion
The Client acknowledges that only once the conditions are fully met with respect to these Terms of Use and subject to the General T&C, the Client will be eligible to receive the Prize. For the avoidance of doubt, the Company has sole discretion in determining the Client’s eligibility throughout the Trade to Paradise Competition and may have additional requirements for the Client prior to determining the Client’s eligibility to receive said Prize.
